Gambling Landscape

Oklahoma saw quite a bit of drama involving sports betting legalization a few years back, and it all started after the state Governor Kevin Stitt ended up in disagreement with the local tribes, which held gambling rights in the state. According to reports from that time, the disagreement emerged after Stitt announced that the tribes’ gaming compacts expired on January 1st, 2019, which suited him well, as he wanted to renegotiate the compacts that year, which is what he offered to the local gaming tribes.

In July 2019, as many as 29 tribes signed a letter to the governor, explaining that they were under the impression that the compacts would be renewed automatically upon expiration. Some tribes went a step further, with Chickasaw, Cherokee, and Chocktaw filing a federal lawsuit, and nine other tribes joined them sometime later. One of the tribes, the Otoe-Missouria, was among those who joined the lawsuit but then eventually dropped out as they managed to renegotiate their compacts to mutual satisfaction.

After long negotiations, Stitt decided to offer sports betting as part of the new compact to the tribes, but the Oklahoma Indian Gaming Association claims that the tribes turned the offer down. To put it simply, the offer permitted betting on all but in-state college teams and events, but the tribes were not very interested in this turn of events.

The situation escalated after the offer became public, and Attorney General Mike Hunter reacted by first disagreeing with the governor’s actions and then publishing a formal opinion that stressed that the governor had overstepped his authority and that he could not offer such a deal to the tribes. By the end of it, House Speaker Charles McCall and Senate President Pro Tempore Greg Treat both sued the governor for offering what was not in his power to offer, and the touch ruled against the governor. The entire effort was sidelined before sports betting even came close to launching.

This brings us to 2022, as earlier this year, Rep. Ken Luttrell introduced a bill known as HB 3008, which aimed to legalize sports betting for tribes that wish to include it in their businesses. Unfortunately, the deadline for passing the bill came before the Legislators could reach an agreement, and the bill was automatically shot down.

The future of Oklahoma sports betting

While the Governor managed to reach quite high stages of his scheme to bring sports betting, the authorities realized his intention in time and it never became a legalized activity in Oklahoma. Of course, 2022 has brought efforts to do it properly, but for the time being, such efforts were unsuccessful, and sports betting remains illegal. Representative Ken Luttrell is still optimistic about the future, but for the time being, there is no timeline that would suggest when sports betting will become legal in the state.

The situation is the same with mobile sports betting, although it can be said that online sports betting remains even more uncertain since the 2022 bill did not include it. Still, there are those who have it in mind, and their goal, for the time being, is to include online sports betting language in further discussions of the matter.

What are the sports betting options in Oklahoma?

For the time being, there are no legal sports betting options in the state of Oklahoma. The situation could change fairly quickly starting in 2023, depending on the tribes and the regulators, as the tribes could decide to once again renegotiate the terms of sports betting moving forward, which would likely lead to the legalization of it, and the arrival of retail and mobile sports beting in the state.

In the meantime, the only other option for Oklahoma’s citizens would be to use foreign sportsbooks that offer their services to US users. While this is risky because the sportsbooks could decide not to pay the winnings to their users — in which case the US could not really do anything to them — the chances of this are minimal on licensed platforms.

Another issue is the fact that these platforms are not licensed to offer such services in the US, so their offering is technically illegal. As for those who decide to access such platforms in the first place — doing it is also not legal, although the chances of anyone being arrested, sued, or otherwise is extremely low. After all, it has never happened so far.

What are the most popular sports to bet on in Oklahoma?

As far as legal sports betting in Oklahoma is concerned, the closest option that comes to this is horse racing and betting, which is actually already fully legal in the state. There are three available horse racing tracks, including Fair Meadows Tulsa, Remington Park, and Will Rogers Downs. However, not much else is available at this moment.

Daily Fantasy Sports, or DFS, is not explicitly legal, but it was also not banned. This allowed DFS operators to accept contest entries from the users based in Oklahoma, however, and since these are major DFS firms that operate throughout the country, providers like DraftKings and FanDuel have been using this opportunity to service Oklahoma-based requests.

Other than that, Oklahoma is the most interested in college sports, particularly when it comes to football and basketball at the local Universities.
