Journey to Sports Betting Legalization

Massachusetts legalized sports betting, when Gov. Charlie Baker signed the Massachusetts Sports Wagering Act into law in 2022 August.  The first licensed betting sites in MA launched in 2023. The original bill for sports betting was passed in 2021, but the MA lawmakers needed to agree on the framework in which they could open a sports betting market in Massachusetts. With only 2 hours left in the legislative session in 2022, finally, the House and Senate agreed on a sports betting bill.

The Massachusetts Gaming Commission oversees the sports betting in the state. The Commission can issue licenses to sportsbook operators, both online and retail, and it also regulates all the horse racing betting in the state. The gambling age for casino gaming, DFS and sports betting in Massachusetts is 21+ but if you want to play in the Massachusetts state lottery, the requirement is only 18+. The lottery, which is also quite popular, has been around since 1971.

After the first year of online sports betting in MA, the state reported a $5.98 bn tax handle, from online bets alone. Soon after, 2 of the 8 licensed sportsbooks closed operations in the Bay State. As mentioned, DraftKings is the market leader in Massachusetts, and through its online sports betting platform, the sportsbook had an 11.7% majority in wagers, followed by FanDuel with a 9.1% hold.

MA Sports Betting Requirements

The MA laws on sports betting are good if you want to bet on major US sports and international professional sports leagues. However, there are quite a few sports bets that are prohibited in MA. You cannot bet on college teams based in Massachusetts (in-state college teams). That is, unless they are participating in a tournament. Also, you cannot bet on tournaments in which the final outcome is based on the evaluation or assessment of a judge or a panel. Forget about betting on the Olympics (summer and winter), World Athletic Championships, Skating Championships, Bobsleigh, Skiing, and other similar events and sports.

Apart from sports betting, there are also casinos and race tracks. There are two full-scale casinos — MGM Springfield and Encore Boston Harbor — and one race track that features slots, or a so-called racino known as Plainridge Park Casino. Obviously, with the race track operational, horse racing and horse betting are both legal, and you can bet on horse racing in Massachusetts in person or online using websites such as TVG. If you choose to do it in person, however, you will have to go to Raynham Park or Suffolk Down, in addition to Plainridge Park.

Lastly, we have daily fantasy sports, with Massachusetts often calling itself the DFS capital in the United States. DFS is fully legalized and available for bettors to access at any time. Once again, the market leaders are the locally-based DraftKings, but FanDuel follows closely behind.

State-Approved Betting Sites

There are currently 6 MA betting sites that are licensed by the Massachusetts Gaming Commission.

  • DraftKings
  • FanDuel
  • BetMGM
  • Caesars
  • ESPN Bet
  • Fanatics Betting & Gaming

The Bay State has 3 retail sportsbooks, the MGM Springfield (BetMGM), Encore Boston Harbor (Caesars Sportsbook) and Plainridge Park (was PENN Entertainment).

Popular Sports and Franchises in Mass

Sports betting in Massachusetts is growing at a phenomenal rate, and it is largely thanks to the great local sports franchises in MA. For example, the NFL’s New England Patriots have been the bettors’ favorite for years. MLB is also a great hit, with the Boston Red Sox having extremely loyal fans. Then, there’s the NBA all-time leading Championship winners with Celtics, and in NHL, the Boston Bruins.

MA has a rich college sports scene, with numerous FBS Division I basketball and college football teams. The UMass Minutemen, Stonehill Skyhawks, Harvard Crimson and Boston College Eagles are among the most popular college teams in the state. But you cannot bet on them if you sign up at a licensed online sportsbook. The law may state that you can bet on them if the tournaments are not held in MA, but generally speaking, licensed sportsbooks tend to avoid college bets in fear of any state retribution.

Alternative MA International Betting Sites

There are plenty international casinos and/or sportsbooks that claim that citizens from the entire US can join their websites and bet as much as they want. Unfortunately, betting at these sites is a legal gray area, as these platforms do not have the US license to offer such services, but they are also outside of the US jurisdiction, so neither the country nor its states can do anything about them.

As for gamblers, accessing and betting on these platforms is not technically a crime, so any legal consequences are highly unlikely. However, it is still risky because the US government cannot control these platforms, and so if they decide not to pay you your winnings or return your deposit — there is nothing they can do about it. It should be noted that platforms that are regulated and licensed elsewhere are highly unlikely to do anything of the sort since they still have reputations to uphold, and they are fully regulated and serious platforms. However, if you plan on taking this route before Massachusetts brings forth its own sports betting, make sure that the platforms you will use are indeed among the licensed ones.

Why Pick International Over US-Based Sportsbooks

With so many top licensed sportsbooks to pick from, it begs the question why would you look for alternatives? But on closer inspection there are plenty of valid reasons why sports bettors in MA pick international sites ahead of the regulated ones.

The international betting sites can offer you those bets which the US-based sportsbooks cannot. Namely, March Madness, NCAA College Football, Olympics, Athletics Championships, and a plethora of other betting markets. They also have a wider global sports coverage, and tend to offer a greater diversity of player bets and props bets.

If you like big bonuses, then you will be more satisfied with what the international betting sites have to offer. Because of running costs and high income tax, the best legal betting sites in MA cannot compete with the foreign sites in terms of sports bonuses. To put that into simple terms, they don’t offer the same insurance bets, bonus bets, cashback offers and boosts that you can get at an international site.

You also cannot bet using cryptocurrencies at licensed sportsbooks. The internationally-regulated ones do accept cryptocurrencies, and you can win valuable BTC, LTC or XRP at these sites. All the international sites that we have picked offer options for crypto gamblers, and they are fully regulated in their respective jurisdictions. As such, the payment methods are all tried and tested, and the sportsbooks uphold strict player-protecting gambling laws. In essence, you are in completely safe hands if you sign up at any of these trustworthy international betting sites.
