Georgia’s initiative to legalize sports betting

2020

Georgia’s efforts to legalize sports betting came a bit late, and only after its neighboring state of Tennessee legalized it first. In February 2020, a group of Senators started the process by presenting a bill named S 403, which suggested enabling online-only sports betting, which was fairly similar to what Tennessee itself has brought. The bill also called for a 10% tax rate and an annual fee for maintaining a license that would sit at $900,000.

Unfortunately, the bill died in committee. But, the massive budget crisis caused by the COVID-19 pandemic that went worldwide around the time resulted in the lawmakers reviving the proposal later in the session by amending the language onto a bill that was still alive at the time.

Rep. Stephens then put his H 378 bill into an unneeded Senate bill. His legislation intended to allow the citizens to vote on the matter of legalizing casinos, sports betting, and horse racing. However, constitutional amendments are difficult to pass, as they require a two-thirds vote in the legislature. Still, he believed that the gambling expansions would be approved by the voters. But, this never happened, as the legislative session ended with no forward motion on the amendments.

2021

Rep. Stephens was not discouraged by the events of 2020, however, as he redoubled his efforts in 2021, with the start of the new session. It was not long before he unveiled a follow-up to his original bill, this one known as HB86. The bill once again proposed online-only sports betting, as well as remote registration, and as many as six licensees. One big thing that was different about this bill was that it did not allow for collegiate wagering.

Without waiting to see what would happen with HB86, however, Stephens’ colleagues came up with their own bill known as SB142. This one was daily similar to the House version, although it had different views when it came to betting on college games. It also came with a companion, SR135, which put the question on a referendum for voters, and they both passed the Senate.

The situation surrounding sports betting remained highly controversial, however, and it grew into a real political battle. Things got heated enough for NAACP to step up and publicly announce that it opposes sports betting in Georgia. The situation stopped the progression of the two bills despite their smooth passage through the state’s Senate.

2022

Earlier this year in February, the battle continued. On February 18th, the Senate committee held a hearing on multiple bills involving horse racing. However, it did not include anything involving actual sports betting. Exactly one month later, on March 18th, a new proposal emerged, suggesting that voters should be allowed to decide whether horse betting should be legalized. However, it did not advance from the Senate in time, and it crossed the deadline.

On March 28th, Rep. Stephens returned to the scene after amending two gambling bills that the Senate already passed in 2021. Both of them were approved in a House committee. Unfortunately, on April 4th, the 2022 Georgia Legislature ended without passing the bills.

With no solution in sight for Georgia, most of its citizens interested in betting had to resort to traveling to surrounding states that have legalized sports betting in order to engage with it themselves, which is exactly what they did.

Is sports betting legal in Georgia?

The short answer is — no. Despite the efforts seen over the past three years, sports betting was not legalized in Georgia, and there are currently no legal options to engage with it. However, there is clearly interest in Georgia, and there are also outside forces interested in seeing sports betting in Georgia, including a major online sportsbook called FanDuel-

In 2021, the company invested $15 million to bring an IT center to Atlanta. Also, with the sports betting bills actually passing through the state’s Legislature last year, it might not be a stretch to say that sports betting might arrive in the relatively near future.

The status of sports betting in Georgia

Our summary of the legislative efforts over the past few years is clearly indicating that there is demand for sports betting in Georgia, even though the attempts to legalize it came closer to being successful in 2021 than in 2022. In fact, if the situation played out differently and if the unrelated breakdown in the House over voting rights did not happen, the bills would have possibly reached the governor’s desk. At this point, we will never know what could have happened.

The only thing that is certain is that the legal sports betting demand is Georgia has strong support. Despite this, gambling could be a tough sell in the state, as it is one of the handfuls of US states that does not have commercial or tribal casinos.

When will Georgia see the launch of online sports betting?

At this time, it is difficult to answer this question. The efforts of 2021 and 2022 to bring forth online betting in the state have failed, which means that pro-sports betting lawmakers will have to bring the issue back in 2023. As a result, online sports betting will not launch in Georgia before then, and even then — it will only come if one of the future bills addressing the situation passes into law.

It is also worth noting that it will likely take months after the bill(s) pass to set up a working system in the state, so perhaps, even under the best of circumstances, online sports betting cannot arrive before 2024.

If the situation does finally reach a resolution, however, we expect to see a number of major online operators emerge. These already have a large presence throughout the country, in states that have approved online sports betting. With Georgia being in the middle of SEC country, NCAA football is the number one thing in the state. Unfortunately, Georgia Bulldogs have not won a national title for the past 42 years, but they still have 56 bowl victories. They got the SEC title 13 times, while their rival, Georgia Tech Yellow Jackets managed to win more national titles, four to two.

2. MLB betting

Georgia has its own major league baseball teams, with the most successful one being The Atlanta Braves. The Braves are one of the National League’s two remaining charter franchises. They were also the only MLB team to win the World Series for three cities, with a 1995 victory in Atlanta itself.

3. NFL betting

Moving on, we have NFL betting, which is likely to be quite big thanks to Atlanta Falcons which nearly won the Super Bowl back in 2016.
