Discord Says Take-Two Hasn’t Served GTA 6 Leak Subpoena Yet

Discord says it has not been served with the subpoena at the center of Take-Two Interactive‘s legal campaign to unmask the person or group leaking Grand Theft Auto VI gameplay, pushing back on a week of reporting that had the platform already in receipt of the publisher’s demands.

“Discord has not yet been served with a subpoena from Take Two,” Ryan Rigney, Discord’s marketing director, wrote on X on 24 de agosto de 2026. “When we do, we’ll evaluate the validity and scope before responding.”

The statement lands five days after Take-Two, parent company of GTA developer Rockstar Games, began filing requests for subpoenas under the Digital Millennium Copyright Act in the U.S. District Court for the Southern District of New York. The filings target accounts associated with “Cyberleek,” the alias behind a rolling series of apparently authentic GTA 6 gameplay clips that began circulating in mid-agosto de 2026, days before Rockstar’s own extended look at the game, scheduled to premiere on Netflix, YouTube and the GTA 6 site on 27 de agosto de 2026.

What the Filings Actually Demand

The subpoena documents, filed August 20 and 21 de agosto de 2026, are directed at Microsoft, X Corp. and Discord. The Microsoft subpoena’s attachment demands “all identifying information associated with all user accounts that are/were members communicating with the Discord server(s) listed below during the time period from 1 de junho de 2026 to present,” and for each returned account the account ID, registration email, registration and last-login IP addresses, phone number, linked connections, device identifiers and “content related to Grand Theft Auto (‘GTA’), Rockstar or Cyberleek from their OneDrive account.”

The named Discord servers include the Ødyssey.gg cheat community guild, the “! Odyssey” public brand guild, and a server tied to the editors of GTA streamer DarkViperAU. Named accounts include CYBERLEEK, CINEMATICROCKSTAR and a handle listed as Surfer24k, with replacement handles cyberleek_west and surwest. The same subpoena seeks Microsoft’s own internal investigative records on the “cyberleek” persona, with a production date of 4 de setembro de 2026 at 10:00 a.m.

A separate petition targeting X Corp., filed 21 de agosto de 2026, names the account @cyberleekario and cites three posts carrying what Take-Two describes as infringing GTA 6 content. Both filings state the publisher’s declared purpose: “to obtain the identity of an alleged infringer or infringers,” with the information to be used “only for the purpose of protecting Take-Two’s rights.”

How a DMCA Subpoena Works

The filings are not lawsuits. They are requests under a provision of the Digital Millennium Copyright Act that lets a copyright holder ask a court clerk to issue a subpoena identifying an alleged infringer, without filing a full complaint or persuading a judge on the merits of an infringement claim. The rights holder must attach a sworn declaration, a copy of its takedown notice, and a statement that the identity will be used only to protect its copyrights. The Microsoft docket shows Judge Jennifer L. Rochon signed an order on 21 de agosto de 2026 directing the clerk to issue the subpoena for Microsoft.

That mechanism explains the gap Rigney is pointing at. A court order directing a clerk to issue a subpoena is not the same thing as service on the company named in it. Until the subpoena is formally served, Discord has no obligation to respond, and its statement that it will “evaluate the validity and scope” signals the platform intends to review the demand, and potentially object to its breadth, before producing anything. The subpoena’s own text includes the standard federal rule language allowing a recipient to serve written objections before the compliance date.

The Crackdown So Far

The subpoenas are the legal edge of a broader enforcement sweep. Take-Two has been issuing DMCA takedown notices across platforms as reuploads of the leaked clips accumulate millions of views, and the X Corp. petition includes the takedown notice sent to that platform as an exhibit. Gaming.net has tracked the leak campaign since the Cyberleek group began posting daily gameplay videos, which it has paired with promotion of a cryptocurrency.

The enforcement push arrives in the final stretch of the most closely watched launch in Take-Two’s history. GTA 6 is the centerpiece of a fiscal-year outlook the company held steady earlier this month on the strength of NBA 2K and GTA bookings, and pre-order data has been running hot, with buyers picking the $100 Ultimate Edition over the standard edition by a nine-to-one margin.

What Happens Next

Two dates now anchor the legal track. Microsoft faces a 4 de setembro de 2026 production deadline under the subpoena’s terms.
