Gambling Landscape

In January 2023, the House approved legislation that would legalize sports betting in the state, this is after the first big attempt to legalize it came in 2019, when two bills that aimed to legalize sports betting as a game of chance both failed. One did make it farther than the other, however. Both bills aimed at allowing charitable gaming organizations to offer sports betting.

However, the bill known as HB 1295 wanted to limit it to professional sports, but it didn’t even pass the House. The other bill, HB 1254, managed to reach the Senate, and it wanted to allow betting on collegiate sports as well. However, the Senate prevented it from reaching the Governor.

Following the failed effort, many expected the initiative to re-emerge in 2020, but this did not happen, most likely due to the global pandemic, which pushed all other matters to the side, so the legislators did not even try to submit any bills aimed at legalizing ND sports betting. However, the following year finally managed to bring forth sports betting in North Dakota in early December 2021.

According to the new law, sports betting can only take place legally in tribal casinos in the state, of which there are three at this moment. All three are owned and operated by the Dakota Nation Gaming Enterprise. With this being the case, only in-person retail sports betting is currently allowed, as the law that legalized it did not mention online sports betting at all.

When will online North Dakota sports betting launch?

While retail sports betting is allowed at the three tribal casinos operating in the state, there is no timeline that predicts the arrival of online sports betting or even the potential for online sports betting. North Dakota might see new efforts to legalize mobile sports betting in the future, but for the time being, there is no way to engage in it legally or go through the remote registration process.

Given that North Dakota is the 47th state in the US based on population density, it is unlikely that the state would be able to see major tax revenue from sports betting. The activity is also not as extremely popular as it is, and so it remains unknown whether the state lottery would want to offer online sports betting as part of its service. The fact that the ND lottery is different from a typical state lottery is also making matters more complicated. The North Dakota lottery only allows multistate games, like Powerball.

North Dakota, unfortunately, does not have any professional sports teams. With that being the case, it is quite difficult to identify the bettors’ favorites. Even so, it is likely that football will be among the top sports, as it is in most other states. However, hockey could also easily be the close second.

Most states that don’t have professional sports teams have seen the rise of college sports teams which filled that gap, but in North Dakota, this is also not the case. The state has a few college sports teams, such as the University of North Dakota and the North Dakota State, but neither of these is a major Division I college sports team. One team that could benefit from the local allegiances is the Philadelphia Eagles.

Daily fantasy sports contests are not legalized in the state, but they can be accessed, as they were never banned. They were simply ignored, which is good enough for major country-wide DFS providers such as FanDuel, Yahoo!, and DraftKings, all of which accept entries from ND citizens.

One form of betting that is legal, however, is horse racing and pari-mutuel betting. However, there are only two horse tracks in the state — ND Horse Park and Chippewa Downs.
